Speaking at the Town Board’s public hearing on the six-month building moratorium, Eugene, a municipal attorney who practices land use and zoning, argues that the Town’s proposal is a pause timed to the election rather than a plan. He points out that it runs through Election Day, expires in March, and commits the Town only to “endeavor” to adopt new zoning, with no deadline and no deliverable.
He says the moratorium does not touch the 2023 and 2025 rezonings that opened the hamlet centers in New City, Congers, Valley Cottage, and West Nyack to high-density development, and that it exempts projects that already have their environmental sign-off. He disputes the claim that a 12-month moratorium would be illegal, noting that New York courts have upheld moratoriums of that length, and that the Town’s own comprehensive plan calls moratoriums the right tool for large-scale zoning changes.
His ask: a 12-month moratorium aimed squarely at the 2023 and 2025 hamlet rezonings, the full environmental review of what all of the pending development adds up to, and a rewrite of the zoning code done in the open, with residents in the room.
